What Is a Will?

A will is a legal document explaining who inherits your assets after you pass.It also names an executor and guardians for minor children.

Requirements in Illinois

  • Signed by you

  • Witnessed by two adults

  • Made while of sound mind

What a Will Controls

  • Personal belongings

  • Real estate (if not in a trust)

  • Bank accounts not jointly owned

  • Guardianship

A will does not avoid probate.
